Abstract

The prevalence of sexual violence cases in Indonesia poses a major challenge for the state in providing protection and recovery to victims. The purpose of this study is to identify alternatives for fulfilling the rights of victims of sexual violence through the victim trust fund mechanism. The issues are whether the existing restitution process has been effective and whether the regulations governing the victim trust fund can serve as a legal reform that fulfills the rights of victims of sexual violence. The research method used is normative legal research with a legislative and comparative approach. The results show that the fulfillment of the rights of victims of sexual violence through the restitution process has not been carried out properly, thereby hindering the recovery process for victims. This is because restitution payments face various obstacles, including an incomplete regulatory mechanism, complicated application procedures, and weak coordination between law enforcement agencies. In addition, many perpetrators are unable or unwilling to pay restitution, making it difficult to enforce the verdict. The absence of effective enforcement mechanisms, minimal assistance for victims, and the lack of bailout funds from the state also mean that victims often do not receive their full rights. The government regulation on victim assistance funds that was finally passed did not address the issue of certainty of restitution payments through compensation, nor did it provide a further mechanism regarding the source of funding for the victim trust fund. Ultimately, the issue of restitution remains unresolved and questions remain. Therefore, clear legislation on the fulfillment of restitution payments is needed, accompanied by a long-term policy framework so that related legislation is not drafted hastily. In this way, the state can promote a reform of the national legal system that favors victims and upholds the value of justice.
