Abstract

Indonesia's competition law is established to maintain a healthy economy and improve societal welfare, despite facing challenges such as the shift to digital realms. To ensure fair competition, Indonesia has Law No. 5 of 1999, which, among other things, prohibits the abuse of dominant position. This provision becomes relevant when Google LLC, a U.S. based company, is alleged to have abused its dominance through the implementation of Google Play Billing, harming developers and consumers. This study aims to analyze the settlement of disputes involving the abuse of a dominant position by Google LLC in Indonesia and the United States, as well as to examine the company's responsibility to the parties harmed in the dispute. The research method used is normative juridical, employing statutory, comparative, and case approaches. The first finding reveals differences in competition law regulations between Indonesia (Law No. 5/1999, KPPU) and the U.S. (Sherman Act, Clayton Act, FTC/DOJ), with the U.S. Google LLC case providing consumer restitution via the Federal Trade Commission Act (amended by U.S. SAFE WEB Act 2006). The second finding indicates that KPPU Decision No. 03/KPPU-I-2024 does not address compensation for harmed consumers yet. Recommendations include strengthening the Anti-Monopoly Law to integrate consumer protection as in the U.S., and KPPU collaboration with digital agencies to fairly address digital dominance.
