Abstract
The Government of Indonesia enacted Law Number 6 of 2023 on Job Creation as a strategic measure to enhance the investment ecosystem and create employment opportunities by simplifying business licensing procedures. One of its key policies is the implementation of Risk-Based Business Licensing as regulated in Government Regulation Number 5 of 2021. However, in practice, this policy faces several challenges, including suboptimal integration of authority among institutions, difficulties in fulfilling basic requirements, inconsistencies in risk classification across sectors, and technical issues within the Online Single Submission (OSS) system. These problems have resulted in legal uncertainty, particularly affecting the confidence of foreign investors. This study aims to examine the implementation of the risk-based licensing system using a normative legal research method and a statutory approach. The findings indicate that despite its goal of ensuring legal certainty and administrative efficiency, the implementation still suffers from institutional and substantive weaknesses. Institutional issues include poor coordination and overlapping authority, while substantive issues relate to inconsistent regulatory norms and the lack of harmonization in implementing regulations. Therefore, a regulatory evaluation and revision are necessary to improve the effectiveness of the system and foster a more conducive investment climate in Indonesia.
