Abstract
The advancement of digital technology has had a profound impact on society, particularly in the widespread adoption of communication applications like WhatsApp. However, behind this convenience lies a serious threat in the form of cybercrimes involving account hacking and the misuse of users' data. This phenomenon suggests that the legal protection of personal data in Indonesia has not yet been optimally implemented. This research aims to analyze the responsibilities of law enforcement authorities in handling WhatsApp hacking cases and to evaluate the implementation of personal data protection by the Law on Electronic Information and Transactions (ITE Law) and the Personal Data Protection Law (PDP Law). This study employs both normative and empirical juridical methods, using statutory and case study approaches. Data collection techniques include a literature review and interviews with victims of account hacking. The findings reveal that although normative legal protections exist, their implementation in practice remains far from ideal. Law enforcement agencies have not performed their functions effectively, as shown by slow responses, lack of adequate supporting tools, and limited understanding of digital crime patterns. This situation highlights a gap between legal norms (das sollen) and legal practice (das sein). This research provides a critical contribution by highlighting this normative-practical gap, reinforcing the urgency of reform in digital law enforcement, and raising public awareness regarding their rights to personal data protection. The conclusion and recommendation of this study emphasize the need to strengthen the capacity of law enforcement officers and empower the public to safeguard their data.
