Abstract
Limited land in urban areas has encouraged the massive development of apartments as an alternative to fulfill people's housing needs. In practice, many developers offer these residential units through a Sales and Purchase Agreement (PPJB) scheme, even when the project has not yet entered the physical construction stage. However, problems arise when the developer is declared bankrupt, so that apartment units that have been ordered and paid for by consumers are often considered part of the bankruptcy estate. This condition creates legal uncertainty and harms consumers, because there is no regulation that explicitly protects consumers' ownership rights over units obtained through PPJB. This imbalance is exacerbated by inconsistencies in court decisions on similar cases, which weaken legal protection for consumers. This research aims to examine the legal certainty of condominium ownership based on PPJB in the context of developer bankruptcy, and assess what legal steps can be taken by consumers. The type of research used is normative juridical by examining legal materials using the library research method. The findings show that the PPJB still has legally binding force between the developer and the consumer. However, in the bankruptcy process, consumers are only recognized as creditors without special rights.
