Abstract

One of the Constitutional Court's (MK) authorities is conducting formal examinations of laws against the 1945 Constitution, as seen in the examination of Law No. 11/2020 on Job Creation. The Constitutional Court Decision No. 91/PUUXVIII/2020 declared the Job Creation Law formally flawed and conditionally unconstitutional. Consequently, the MK granted lawmakers a two-year period to revise the law, adhering to standardized omnibus law formation procedures. However, the Government responded by issuing Government Regulation in Lieu of Law (Perppu) No. 2/2022 on Job Creation, which closely resembles the original law, sparking public controversy. This research employs a normative juridical approach, emphasizing library research. The study adopts a descriptive-analytical method, focusing on secondary data analysis. The research findings indicate that the Constitutional Court Decision No. 91/PUU-XVIII/2020 was not complied with by lawmakers, as they failed to amend the Job Creation Law as directed. Instead, they issued the Job Creation Government Regulation in Lieu of Law (Perppu). Furthermore, analysis reveals discord between the Perppu and the Constitutional Court's legal considerations.
