Abstract
This thesis describes and examines the problems of the house buying and selling system with murabahah contract in Islamic banking, especially at Bank Tabungan Negara Syariah. This research is a normative legal research that is prescriptive in nature. The data used in this study are secondary data which include primary legal materials. The data collection techniques used are literature studies and interviews as supporting data, the analysis technique used is the deductive method. The results of the study indicate that in the house buying and selling system with murabahah contract at Bank Tabungan Negara Syariah, South Tangerang Branch Office, there are seven systems or methods as follows: 1. Customers order a house from the developer/seller; 2. Minutes of the house order along with the completeness of the customer's administration are submitted to Bank Tabungan Negara Syariah; 3. Bank Tabungan Negara Syariah verifies and analyzes the customer's ability to pay by referring to the price ceiling of the house being bought and sold; 4. Bank Tabungan Negara Syariah then gives the customer the power to ensure the order of the house of his choice to the Developer or seller with a wakalah contract; 5. Bank Tabungan Negara Syariah buys the house based on the selling price set by the Developer/seller; 6. Bank Tabungan Negara Syariah sells the house to the customer with the amount of the principal plus a margin (profit) according to the time period that has been determined and agreed upon between the bank and the customer; and 7. Conducts a murabahah contract between Bank Tabungan Negara Syariah and the customer attended by the related parties: the first Developer/seller, and a local Notary to make records. The house buying and selling system with a murabahah contract at Bank Tabungan Negara Syariah, South Tangerang Branch Office has not fully provided justice for customers. The bank tends to: 1. Determine the margin unilaterally; 2. Margin is greater than the principal price or monthly installments; 3. Customers cannot make a selling price offer; and 4. Customers cannot make settlement payments if three extra payments have been made. So customers must follow the decision of Bank Tabungan Negara Syariah (BTN Syariah).
