Abstract

Article 43 paragraph (3) of Law Number 12 Year 2011 mandates that every bill proposed by the President, the House of Representatives, or the Regional Representatives Council must be accompanied by an Academic Paper which contains the results of in-depth legal studies on a problem that can be proven scientifically about the need to regulate a certain problem and its problem solving in a Draft Law. The Academic Paper then becomes a reference in the formation of laws and regulations in the planning process. The research is aimed at knowing, explaining and analyzing the role of the Academic Paper in the formation of a law and analyzing the results of the discussion of the Amendment Bill to Law Number 5 of 2014 and the compliance of its substance with the Academic Paper. This research is a juridical normative research (doctrinal legal research). The substance in Law Number 20 Year 2023 has accommodated the strategic issues in the Academic Paper of the Bill even though the Academic Paper was not amended during the discussion process, where there is an addition of substance of more than 50% (fifty percent) which results in the Bill on Amendments to the State Civil Servant Law after being issued into Law Number 20 of 2023 of State Civil Servant (revoking Law Number 5 of 2014 of State Civil Servant Law).
