Abstract

Enforcement against cartel practices in Indonesia faces significant challenges, including evidentiary difficulties and limited powers of competition authorities. Cartels, which involve conspiracies to influence prices and production, are prohibited by Law Number 5 Year 1999. This research uses a normative juridical method with comparative, conceptual, statutory, and case approaches. The data source is secondary data obtained through literature study and analyzed qualitatively. The research also discusses the application of the leniency program implemented in the United States as an effective effort to uncover cartels. This program provides incentives for cartelists who report to uncover cartel networks, which has proven to be helpful in law enforcement in developed countries. In Indonesia, the implementation of a similar program has not been optimal due to the lack of supporting regulations and a legal culture that has not been fully supportive. This study suggests the renewal of Law No. 5/1999 to strengthen the KPPU's authority and the implementation of the leniency program to create a healthier and fairer business competition climate.
