Abstract

An employment agreement is an agreement between an employer and a worker which is the first step in forming an employment relationship. The Labor Law encourages the creation of employment agreements to be recognized as legal by law. Written employment agreements have an important role as a binding tool and evidence. However, often in the principle of justice in the termination of employment relations is carried out unilaterally, which can cause legal problems, especially related to workers' rights, such as the Case Study of the Mamuju District Court Decision No. 2/PDT. SUS-PHI/2018/PN. Mam The research method in this journal is a descriptive analysis that leads to normative juridical legal research, namely research. Secondary data by processing data from primary legal materials, secondary legal materials and tertiary legal materials. The results of the study show that the principle of fairness in the payment of termination of employment for workers in Indonesia is reviewed from the laws and regulations. However, the weakness is that because the provisions that result in termination of employment are not agreed in writing, the provisions are proven by the will of the Parties, then the Panel of Judges in the Decision of the Mamuju District Court No. 2/PDT. SUS-PHI/2018/PN sentenced Defendant II to pay 2 times the Plaintiff's rights because the termination of employment carried out with threats is irrelevant and cannot be proven because the Plaintiff is willing to follow the provisions or policies of the Company which results in termination of employment.
