Abstract
Indonesia's Health Transformation is experiencing rapid development. The government through the Ministry of Health has launched 6 (six) Health Transformation Pillars, one of which is the Transformation Pillar. Health technology related to health information systems has also developed very rapidly in the health sector, one of which is electronic medical records (RME). Electronic medical records have been used in various world health service facilities as a form of transition in the form of health records from paper to electronic form in all Health Service Facilities in Indonesia. The complexity of implementing RME with its various challenges, so that an evaluation is needed to assess the readiness for implementing RME. RME Governance is often unable to face obstacles that require solutions in order to produce effective changes to new technology information systems. Renewal of the electronic information technology system can guarantee the security of RME data. Regulation of the Minister of Health of the Republic of Indonesia number 24 of 2022 regulates the Implementation of RME through Cooperation Agreements with PSEs (Electronic System Providers) in Health Facilities, but does not provide a guarantee of legal certainty which poses a risk of data leakage on the part of PSE.To know the implementation of RME and the strength of Protection and Accountability of Electronic Medical Records. to guarantee the strength of legal protection and legal responsibility of RME towards Pratama Clinic. There are obstacles to the implementation of Electronic Medical Records in Indonesia which could pose a threat to data security. There is an urgent need for regulations that specifically regulate Electronic Medical Records regarding rights, obligations and regulation of sanctions if there is a leak of electronic medical record data from the PSE. There are no current RME regulations that specifically regulate the legal protection of electronic medical records. So the existing RME regulations are not yet effective in providing legal protection for RME in health facilities from a legal certainty perspective. The government needs to immediately establish special regulations regarding electronic medical records that regulate technical matters. PSE's rights and obligations with Health Facilities in terms of administering Electronic Medical Records.
