Abstract
This study investigates the participation of minors in drug-related offenses. The objective of this study is to investigate the inadequate execution of the Restorative Justice procedure for adolescent offenders involved in drug-related offenses. The efficacy of incarcerating juvenile offenders involved in substance misuse is diminished when the burden of their rehabilitation is not assumed by law enforcement authorities. The research at hand encompasses two primary inquiries: firstly, an examination of the current regulatory framework pertaining to the legal safeguarding of children engaged in drug misuse; and secondly, an exploration of the potential enhancements that can be achieved in the realm of legal protection for such children through the implementation of Restorative Justice approaches. The present study employs a normative juridical research methodology, utilizing qualitative descriptive data analysis methodologies. The legal safeguarding of children engaged in drug misuse in Indonesia is achieved through the enforcement of several legislative measures, namely the Juvenile Criminal Justice System Law, the Narcotics Law, and the Child Protection Law, as evidenced by research findings. The resolution of issues pertaining to kids engaged in drug misuse should be grounded in the concepts of Restorative Justice, prioritizing the restoration of their initial state rather than resorting to punitive measures such as imprisonment for the purpose of vengeance. From the standpoint that the integration of a Restorative Justice framework should be an essential component of the criminal justice system, it is crucial to examine the restorative approach as a novel paradigm that presents enhanced efficacy in comparison to punitive strategies employed in addressing instances of child drug abuse.
