Abstract
The problem of narcotics crime today has become one of the national problems which is increasingly strenuous to handle, both in prevention and control and in formulating appropriate sanctions on reducing overcapacity in the correctional institution. The formulation of the problem of the thesis is what are the factors which caused the overcapacity in the correctional institution and what is the formulation of criminalization policy against Narcotics Offenders in Solving overcapacity problem in the correctional institution. The research method used in this thesis is the normative juridical law research approach. Based on these two problems, it can be concluded that the factors which caused the overcapacity in the correctional institution are the convict of narcotics crime, the oriented law towards imprisonment, the stigmatization factors against former convicts. Meanwhile, the formulation of criminal policies against narcotics crimes in overcoming the overcapacity problems in the correctional institution includes training the convicts of narcotics, preserving the criminal alternatives beside imprisonment, preserving the formulation of narcotics criminalization in the bill of narcotics.
