Abstract

Indonesia is a country with enthusiasm for performing the Hajj which tends to increase from year to year. On the one hand, the implementation of the Hajj pilgrimage sometimes still reaps problems, one of which is the failure of prospective Hajj pilgrims to leave which has caused losses, so it is necessary to apply the principle of good faith as best as possible by parties to prevent unlawful acts occurring in its implementation. However, in reality, there are many cases that do not represent the principle of good faith, such as in Case Decision Number 101/Pdt.G/2019/PN.Mks. The aim of this research is to analyze the construction of the legal relationship between Umrah pilgrims and prospective Furoda Hajj pilgrims and to find out the application of the principle of good faith along with the rights and obligations related to the responsibility of Umrah Hajj travel for the failure of the prospective Furoda Hajj pilgrims to depart. These problems are analyzed using research specifications through normative juridical data analysis methods and using statue approach and a case approach, collecting research data through library research methods. The author also studied the academic documents and court decisions which were used to obtain data for this research.
