Abstract

Copyright is an integral part of the realm of Intellectual Property Rights (IPR) exclusively granted to creators or copyright holders to announce or reproduce their works, while still adhering to the prevailing legal regulations. One example of a work protected by copyright is governed by Article 9, Paragraph (3) of the Copyright Law No. 28 of 2014. This research aims to comprehend the role of law enforcement agencies in formulating legal policies related to the illegal broadcasting of the World Cup without the permission of the license holder, as well as how judges consider and make decisions in specific cases, such as in the verdict of Semarang District Court Case No. 6/Pdt.Sus-HKI/2018/PN.Smg., associated with the Copyright Law No. 28 of 2014. This study delves into the process through which PT. Inter Sports Marketing obtained broadcasting rights for the 2014 FIFA World Cup, the legal protection provided to PT. Inter Sports Marketing as the holder of the broadcast license for the 2014 FIFA World Cup based on copyright law, and the considerations made by the judge in cases where the broadcast of the 2014 FIFA World Cup was aired in commercial areas without permission from PT. Inter Sports Marketing, the license holder. The research employs a normative juridical method, viewing law as a system of norms. The approach encompasses the analysis of legal regulations and a conceptual approach. Several laws serve as the foundation for this research, including Copyright Law No. 28 of 2014, Copyright Law No. 19 of 2002, and the Civil Code. The findings of this research reveal that copyright law governs how license holders possess exclusive rights and ownership of a direct broadcast creation from its creator. Furthermore, this study indicates that judges decide cases such as Case No. 6/Pdt.Sus-HKI/2018/PN.Smg based on considerations grounded in the rights held by license holders of a particular creation.
