Abstract
The existence of the law and the various development agendas in the case in Wadas Village are part of the instruments of power which can be seen as a series of mechanisms carried out to carry out land grabs. The existence of this law is based on the use of the Land Acquisition Law which is an instrument in carrying out the development agenda. Meanwhile, this development model is manifested in a real way in the National Strategic Project (PSN), which in this case is the construction of the Bener Dam. The public interest narrative is the reason for all development based on the exploitation of natural resources. The process is considered legal because the way land grabbing works is a long chain that is supported by regulations, development plans, and various investment models. This research was conducted using the socio-legal method with two approaches, namely textual studies, articles in laws and regulations, policies; and developing various “new” methods resulting from a marriage between legal and social science methods. The results of this study indicate that development for the public interest is often an excuse for carrying out destructive development practices, large-scale land acquisition, and marginalizing a community from their land/residence which in turn creates the appropriation of community rights. Thus, mining activities in Wadas Village which are legitimized by various regulations and development plans emphasize that the narrative of development for the public interest is nothing more than an attempt to grab land through applicable law.
