Abstract

The COVID-19 pandemic resulted in government policies that limited human activities as a preventive measure against the spread of the virus. This has significantly affected various sectors in the world, including the notary profession. The process of making an authentic deed by a notary that should have been done face-to-face has changed to be done online, thus creating a cyber notary. However, this concept causes issues due to the fact that the formal requirements have not been fulfilled to support the validity of a notarial deed based on the Notary Office Law. Therefore, this scientific study aims to analyze the validity of signing notary deeds online based on applicable law and the proof of the validity of notarial deeds made during the COVID-19 pandemic. This research uses a normative juridical method and produces three facts:During the COVID-19 pandemic, the authentic deed was signed online; there was a violation of Article 16 paragraph (9) UUJN, especially regarding online proof of deed; and there is no legal regulation for proving authentic deeds made online. It is permissible to prove the validity of notarial deeds signed online during the COVID-19 pandemic. However, the implementation of signing authentic deeds online based on applicable law has not been regulated by a specific law.
