Abstract

The Cash on Delivery payment method is here to provide convenience for consumers who want to shop online by ensuring that the goods they buy arrive at their home address first. However, there are problems in the form of defaults due to irresponsible actions of consumers in completing transactions which then harm traders, buyers, and couriers. This research was made to examine problems in the form of defaults committed by consumers who use COD and providing solutions to related parties to reduce potential COD problems in the future. This study uses a normative juridical research method, namely the author examines and studies regulations contained in the Civil Code, Government Regulation Number 80 of 2019, Government Regulation Number 71 of 2019, and Law Number 8 of 1999 concerning Consumer Protection and various regulations other related. This research shows that there are no laws or regulations made by the Government of Indonesia that regulate COD, so they cannot guarantee the safety and welfare of parties who carry out online buying and selling transactions through marketplaces. Therefore, the Government is expected to make special provisions regarding COD which can be carried out by adding COD loads to Government Regulation Number 80 of 2019 concerning Trading Through Electronic Systems. The COD provisions are then expected to be a solution to problems related to COD and to reconstruct the existence of COD so that it becomes an effective and safe online shopping payment method for parties involved in online trade transactions through marketplaces.
