Abstract
The provisions in Law Number 2 of 2014 concerning amendments to Law Number. 30 of 2004 (UUJN) still mandate the element of dealing directly until now. The existence of Covid-19 gave birth to a new policy, namely Government Regulation Number 21 of 2020 concerning Large-Scale Social Restrictions in the Context of Accelerating the Handling of Corona Virus Disease 2019 or Covid-19, the public is encouraged to avoid physical gatherings. This intersects with the Law on Notary Positions and of course can have an impact on the activities of the notary in making the authentic deed itself which requires it to be done face to face. One of the impacts is the existence of legal uncertainty that can harm the parties. Therefore, this study aims to describe and determine the process of making a deed during the Covid-19 pandemic and the obligation to meet the elements of dealing with a notary that must be fulfilled in making a deed during the Covid-19 pandemic, which uses a normative juridical method with a statutory approach. The results obtained that the process of making the deed during the pandemic experienced obstacles, namely limited in making the deed due to the dealing elements that still had to be obeyed. Then there are regulations issued, namely by utilizing electronic media for certain actions. And the Indonesian Notary Association (INI) offers various alternatives through circular letter number 67/35-III/PP-INI/2020 regarding the appeal to prevent the spread of Covid-19.
