Abstract
This study aims to analyze the practice of sharing joint assets through mechanisms outside the court and the legal implications if the distribution of joint assets is carried out out of court. This research is a qualitative research using empirical juridical method. This research is descriptive. This study shows that the practice of sharing joint property can be carried out outside the court by the process of making an agreement in its settlement. The distribution of joint property outside the court was also chosen because of the ease of the litigation process and the freedom of the parties to determine the method of dispute resolution and the freedom to determine the distribution of the object of joint property. Legal Implications of Sharing Shared Assets Out of Court for the birth of rights and obligations that are binding on related legal subjects as well as binding sanctions based on civil law.
