Abstract
Land ownership is legally recognized if it is first registered at the land office, according to the formulation of government regulation No.24 of 1997, with the aim of providing legal certainty and protection of owned land, but in its application there are still many disputes that arise related to land ownership, such as the issuance two certificates on the same parcels of land, such as overlapping land certificates as in the decision of PK No.2 / PK / Pdt / 2008. The problem in this study is 1) how is the sale and purchase of land in the case of PK No.2 / PK / Pdt / 2008 so that it becomes a consideration of judges? with the aim of reviewing the judge's consideration of cases of overlapping certificates and reviewing the legal protection obtained by the land certificate holder. The study uses normative research to be able to show a good sale and purchase of land in the case of the decision PK No. 2 / PK / Pdt / 2008 which is used as a consideration of judges as well as legal protection given to the actual holders in the case.
