Abstract
The Republic of Indonesia and The French Republic have in common in terms of running a system of government with the distribution of power systems for the sake of creating further harmony, the form of unity is fundamental to the two countries. In the structure of democratic government, representative institutions are an important element to respond to the social reality of the formation of representative institutions must be in accordance with the duties, functions and authorities to realize good governance and avoid the abuse of power, method of comparison of the two legislative institutions between the Dewan Perwakilan Daerah and the National Assembly of the French Republic with the aim of finding out the advantages and benefits of the second chambers of France which could then be proposed to the Dewan Perwakilan Daerah. Monstesquieu's bicameral parliamentary theory becomes the principle of the function of the upper house and the lower house of the legislative institutions in terms of legislation and its urgency, which results will make the utilitarianism of the legal policies with aspects of human rights that are just with civilized and populist regions led wisely by wisdom. The functions of the Dewan Perwakilan Daerah have been greatly reduced through the special law that is Art Number 17 Year 2014 about MPR, DPR, DPD, and DPRD (MD3) and through the verdict of the Constitutional Court twice with No. 92 / PUU-X / 2012 and resolution No. 79 / PUU-XII / 2014. One of the excess functions of the National Assembly of the French Republic is to be able to formulate and establish laws.
