Abstract

Embezzlement is an act containing unlawful elements committed by controlling or hiding property owned by a person or other individual without the consent and knowledge of the owner, which is basically with the intention or hidden intention to transfer the position of ownership, control, or use to another party or for certain interests. In Indonesia, legal regulations related to embezzlement are regulated in Articles 486 to 491 of the Criminal Code, new Law Number 1 of 2023. Then, regarding embezzlement of premiums, it has been regulated in Law Number 40 of 2014 concerning Insurance. Therefore, this study explains how the legal regulations regarding the crime of embezzlement of insurance premiums according to positive criminal law in Indonesia and how the law is enforced against the crime of embezzlement of insurance premiums in Decision No. 2342 / Pid.Sus / 2022 / PN.Sby with the intent and purpose to identify, analyze, and understand various aspects related to the crime of embezzlement, both in terms of law, practice and its impact. The results of this study are expected to provide coverage for various specific objectives such as knowing the qualifications of the crime of embezzlement, analyzing the application of criminal law, identifying causal factors, understanding the modus operandi, and providing recommendations for prevention and mitigation.
