Abstract
This study aims to analyze the legal standing in petitions for the suspension of debt payment obligations of insurance companies and to evaluate the juridical consequences for the legal protection of individual creditors, particularly policyholders. This study departs from Supreme Court Decision Number 647 K/Pdt.Sus-Pailit/2021, which granted the bankruptcy petition against PT Asuransi Jiwa Kresna. That decision raised concerns about the petitioner's legal capacity in bankruptcy proceedings against insurance companies. This issue is relevant because Article 2 paragraph (5) of Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations restricts the right to file a bankruptcy or debt suspension petition against an insurance company solely to the Minister of Finance, whose authority now rests with the Financial Services Authority. The research method used is normative legal research with statutory and case approaches. The primary legal materials consist of court decisions and relevant regulations, while the secondary legal materials consist of legal literature. Data analysis was conducted qualitatively and descriptively to explain the regulatory pattern and its implications. The findings reveal two main results. First, the authority to file a petition for the suspension of debt payment obligations of insurance companies is exclusive and limited, and rests solely with the Financial Services Authority, in order to maintain industry stability and protect the collective interests of policyholders. Second, this exclusivity restricts direct access for individual creditors to the litigation forum, thereby creating a high dependency on the Financial Services Authority's administrative response in cases of default. This condition can slow down the debt settlement process and weaken the bargaining position of individual creditors. This study recommends strengthening the supervisory mechanism and transparency of the Financial Services Authority in handling such petitions, in order to provide better legal certainty for policyholders.
