Abstract

This study aims to analyse cooperation between Indonesia and Malaysia in protecting Indonesian migrant workers (PMI) in the domestic sector in accordance with the principles of ILO Convention No. 189. Indonesia and Malaysia have established labour cooperation through a 2022 Memorandum of Understanding (MoU) which regulates the mechanisms for the placement and protection of domestic migrant workers (PMRT). The research findings indicate that cooperation between Indonesia and Malaysia continues to progress, driven by three main factors: national interests, interdependence, and the alignment of interests through negotiation mechanisms and regularly updated agreements. This research also found that a number of provisions in the 2022 MoU reflect compliance with some of the principles of ILO Convention No. 189, particularly regarding the single-channel recruitment system, the prohibition on charging workers placement fees, the requirement for written employment contracts, social security, and the prohibition on withholding personal documents. However, various challenges remain in its implementation, such as a lack of preparation among prospective workers, non-transparent recruitment practices, non-procedural status, and limited access to legal services and information.
