Abstract

The rapid development of information technology has led to contemporary cybercrimes such as cyberstalking, which involves repeated stalking, intimidation, or harassment through digital media. In Indonesia, cyberstalking is not explicitly regulated as a specific offense. Law enforcement still relies on fragmented provisions within the UU ITE, KUHP, and Personal Data Protection Law, leading to legal uncertainty and weak victim protection. Conversely, Singapore has established a comprehensive regulation through the Protection from Harassment Act (POHA). This study aims to analyze the comparative regulations of cyberstalking between Indonesia and Singapore and to formulate an ideal legal framework for Indonesia in the future. This study employs normative legal research with statutory, comparative, and conceptual approaches. The results indicate that Indonesia’s regulations lack adequate legal certainty regarding definitions, criminal elements, and victim protection mechanisms. Meanwhile, Singapore effectively addresses cyberstalking through POHA by integrating criminal sanctions and civil remedies. Therefore, Indonesia urgently needs legal reform by formulating a standalone cyberstalking offense or comprehensive amendments to the UU ITE that are adaptive and victim-oriented.
