Abstract
The development of app-based transportation has brought about various service innovations, including the use of electric vehicles as an environmentally friendly means of public transportation. One company operating in Indonesia is Green SM, an electric vehicle-based transportation company originating from Vietnam. Despite offering various advantages, in practice, various problems are still found, such as traffic accidents allegedly caused by driver negligence, complaints about relatively higher fares compared to other online transportation services, and operational constraints such as limited electric vehicle charging facilities. These problems cause losses for passengers and third parties, thus giving rise to the need for a dispute resolution mechanism that provides legal certainty. This study aims to analyze the dispute resolution mechanism due to driver negligenc in the Green SM transportation service and the form of the company's legal responsibility towards the injured party. The research method used is normative legal research with a statutory, conceptual, and case approach. The results show that dispute resolution is generally carried out through a non-litigation mechanism involving the compan as the party responsible for driver operations. However,there is still uncertainty regarding the standards for dispute resolution and the form of company liability for third-party losses. Therefore, it is necessary to strengthen dispute resolution mechanisms that are more transparent and provide legal certainty for all parties.
