Abstract
The practice of "trial by social media" carried out by recording, uploading, and disseminating information regarding alleged criminal acts—is a phenomenon increasingly prevalent in the digital era. This study aims to analyze how such acts can lead to the spread of slander, defamation, doxing, and cyberbullying. The central issues concern the criminal law framework regarding trial by social media and the criminal liability of those who engage in such conduct. This research employs a normative-juridical method, utilizing both statutory and conceptual approaches. The findings indicate that trial by social media can be legally classified as acts involving the dissemination of slander or false information, as well as attacks on a person's honor or reputation via electronic media; these acts are regulated under Articles 27A and 28(1) of Law Number 1 of 2024 concerning Electronic Information and Transactions, as well as Articles 433 and 434 of Law Number 1 of 2023 concerning the Criminal Code. Consequently, criminal liability may be imposed on individuals who create, upload, and disseminate such information, as the elements of culpability and the capacity to be held accountable are satisfied. Ultimately, it is crucial for the government to conduct extensive and massive public outreach to improve digital literacy regarding the legal consequences of trial by social media, given that such actions constitute criminal offenses. Furthermore, law enforcement agencies are expected to be more responsive and consistent in handling these cases, prioritizing justice and the presumption of innocence.
