Abstract

Increasing number of gold trading transactions in Indonesia that are not always accompanied by comprehensive written agreements, leading to legal issues regarding the evidentiary strength of payment invoices in breach of contract disputes. The purpose of this research is to analyze the position of invoices as evidence and the judges’ considerations in assessing the validity of payment invoices in the dispute between Philip Tanggoredjo and PT Aneka Tambang Tbk. This study employs a normative legal research method with a case approach through the analysis of court decisions, supported by primary, secondary, and tertiary legal materials analyzed qualitatively. The results show that payment invoices are recognized as valid written evidence and play an important role in proving that a payment has occurred. However, invoices do not possess perfect evidentiary value in proving breach of contract without supporting evidence, particularly proof of delivery of goods. Judicial considerations emphasize that the validity of invoices is relative and must be assessed comprehensively alongside other evidence to establish judicial conviction. Therefore, invoices function only as preliminary evidence (prima facie) and cannot stand alone in proving breach of contract disputes.
