Abstract

Medical education plays a crucial role in training competent medical professionals to achieve optimal public health. One of the most fundamental pillars of the medical education curriculum is a deep understanding of human anatomy through the use of cadavers. The use of cadavers for medical education in Indonesia is regulated by Government Regulation (PP) No. 28 of 2024. According to this regulation, cadavers must be obtained with written consent from both the prospective donor and their family. However, unfortunately, the regulation does not specify in detail what kind of legal document must be prepared. This lack of clarity creates legal uncertainty for all parties involved in cadaver donation. The purpose of this study is to determine what form of written consent is required under current positive law and what form of consent provides legal certainty. This study employs a normative legal research method to identify legal rules, legal principles, and legal doctrines in order to address the legal issues at hand. This study was conducted by examining written legal provisions, particularly laws and regulations relevant to the issues to be examined in the study, as well as a conceptual approach focused on analyzing the concepts, doctrines, and legal ideas underlying an issue to establish relevant legal definitions, concepts, and principles. The results of the study indicate that Government Regulation No. 28 of 2024 does not stipulate the form of written consent for cadaver donation. In actual practice, the form of written consent for cadaver donation tends to utilize a will. The form of written statement in cadaver donation that provides the greatest legal certainty is a notarial deed, as it serves as a written instrument of evidence with full legal force.
