Abstract

This study examines the impact of ministerial restructuring on the legal status of ministerial regulations issued by restructured ministries and the normative authority to repeal such regulations. It employs a normative juridical research method using both the statutory approach and the conceptual approach by examining legislation, scholarly literature, and relevant legal theories. The study finds that, from the perspective of the hierarchy of legal norms, ministerial regulations issued by restructured ministries remain legally recognized and continue to have binding legal force insofar as they are mandated by higher legislation or enacted pursuant to lawful authority. From the perspective of the validity of legal norms, such ministerial regulations remain in force unless and until they are repealed, amended, replaced, or declared invalid by competent legislation or an authorized judicial decision. Where a ministry is dissolved and its functions are transferred to a newly established ministry, the authority to repeal the previous ministerial regulations rests with the successor ministry that assumes those functions. Conversely, where a dissolved ministry's functions are transferred to a government agency (Badan), the authority to repeal the former ministerial regulations rests with the agency that assumes the transferred functions, provided that the agency is directly under and accountable to the President. This study proposes an amendment to Law Number 12 of 2011 on Lawmaking by introducing explicit provisions governing the repeal of regulations issued by ministries affected by institutional restructuring. Specifically, it recommends incorporating a general mechanism within Presidential Regulations governing the organization, duties, and functions of government institutions, whereby the formal repeal of obsolete ministerial regulations is carried out through Presidential Regulations, while regulations issued by the head of the successor agency function solely as implementing regulatory instruments within the scope of the new agency's statutory authority.
