Abstract
The United Nations High Commissioner for Refugees (UNHCR), as the primary actor in human security issues, particularly refugee protection, plays a strategic role in providing protection and managing refugee affairs. The humanitarian crisis triggered by the forced displacement of the Rohingya population by the Myanmar military in 2017 resulted in a massive influx of Rohingya refugees into neighboring countries, including Malaysia. As a non-signatory state to the 1951 Refugee Convention and its 1967 Protocol, Malaysia has neither international legal obligations nor a national legal framework governing refugee management and protection. The humanitarian conditions faced by Rohingya refugees in Malaysia serve as the primary perspective through which this study examines the role of UNHCR in implementing its mandate. This study employs the theory of international organizations proposed by Clive Archer, which conceptualizes the roles of international organizations into three dimensions: as an independent actor, a forum, and an instrument. In addition, this research adopts the Human Security concept developed by the United Nations Development Programme (UNDP) to analyze the humanitarian challenges experienced by Rohingya refugees in Malaysia. This research analyzes UNHCR's role in managing Rohingya refugees in Malaysia during the 2017-2019 period using Clive Archer's theory. As an independent actor, instrument, and forum, UNHCR successfully fills the legal vacuum in this non-signatory state by assuming registration and basic protection functions. This management's success is heavily driven by the organization's capacity to strengthen multi-stakeholder coordination and implement a participatory, community-based empowerment protection approach.
