Abstract

This study analyzes the trademark dispute between Hugo Boss and Anthony Tan, focusing on the legal criteria of "substantial similarity" and "bad faith" as applied in Decision Number 27/Pdt.Sus-HKI/Merek/2020/PN Niaga Jkt.Pst. and Decision Number 520 K/Pdt.Sus-HKI/2021. The primary issue addressed in this research is the disparity in legal interpretation between the Commercial Court and the Supreme Court, which has created legal uncertainty for owners of well-known trademarks. This research employs a normative juridical method using both a case approach and a statutory approach. The findings reveal that, at the cassation level, the Supreme Court adopted a more substantive legal standard by overturning the Commercial Court's decision. The analysis demonstrates that the defendant's use of the dominant element "HUGO" constituted substantial similarity and was accompanied by bad faith in the form of free riding on the reputation of the well-known trademark. This study concludes that more explicit legal parameters should be incorporated into Law Number 20 of 2016 on Trademarks and Geographical Indications to minimize judicial subjectivity in resolving similar disputes. Such measures are essential to ensuring both preventive and repressive legal protection for trademark owners in Indonesia while fostering a fair and competitive business environment.
