Abstract

Wiretapping is an intrusive law enforcement instrument that directly limits individuals’ constitutional rights, particularly the right to privacy. In the context of combating corruption as an extraordinary crime, the Attorney General’s Office of the Republic of Indonesia must be equipped with an effective and proactive investigative authority to uncover sophisticated and concealed criminal acts. However, the wiretapping authority stipulated in Article 30C letter i of Law Number 11 of 2021 concerning Amendments to Law Number 16 of 2004 on the Attorney General’s Office remains general in nature and does not fully meet the constitutional standards set forth by the Constitutional Court. This legal ambiguity creates issues of legal certainty, accountability, and potential abuse of power. This study aims to analyze the legal implications of wiretapping conducted by the Attorney General’s Office in corruption cases and to formulate an ideal regulatory model that aligns with the rule of law, human rights protection, and best practices in ASEAN countries. Using a normative juridical research method with statute, conceptual, and comparative approaches, this study concludes that the fragmentation of wiretapping regulations, coupled with the absence of judicial authorization and clear oversight mechanisms, presents risks to constitutional rights and weakens the legitimacy of law enforcement. Therefore, a reconstruction of the regulatory framework is required through the establishment of a Special Wiretapping Law (lex specialis) that specifies the limits of authority, judicial control mechanisms, standard operating procedures, and structured accountability systems to ensure that effective corruption eradication efforts remain consistent with the principles of justice, legal certainty, and human rights protection.
