Abstract

This study examines the application of administrative criminal offenses in cases involving the misuse of pharmaceutical preparations and dermaroller medical devices in beauty clinics, as well as the enforcement of relevant legal provisions based on a case study of Court Decision Number 219/Pid.Sus/2025/PN.Jkt.Sel juncto Decision Number 176/Pid.Sus/2025/PT.DKI. The research focuses on the issue of criminal liability for perpetrators who misuse pharmaceutical preparations and medical devices in beauty clinic practices that fail to comply with health standards and licensing requirements, as well as on the regulation and application of administrative sanctions that carry criminal implications in order to protect public health. This research employs a normative juridical method with statutory, conceptual, and case study approaches, utilizing primary, secondary, and tertiary legal materials. The results of the study indicate that: (1) in the case of Ria Beauty Clinic, the perpetrator was proven to have intentionally distributed and used pharmaceutical preparations and dermaroller medical devices without marketing authorization and without possessing the requisite medical competence, thereby fulfilling the elements of a health-related criminal offense; and (2) the operation of beauty clinics falls within the health administrative law regime, which requires compliance with risk-based business licensing and administrative requirements, including standards related to health human resources, pharmaceutical preparations, and medical devices. The implementation of Administrative Penal Law for violations of the administrative requirements of law Number 17 Of 2023, which contains administrative sanctions, emphasizes government oversight as a policymaker for perpetrators of misuse of pharmaceutical preparations and medical devices without marketing authorization in beauty clinics. Criminal sanctions are also imposed as a last resort (Ultimum Remidum) to provide optimal legal protection for public safety and health.
