Abstract

The application of the death penalty in the Indonesian legal system has undergone changes with the enactment of Law No. 1 of 2023 on the Criminal Code, which introduces a 10-year probation period as a more humane form of law enforcement. This study aims to analyze the construction of conditional death penalty regulations in the National Criminal Code and examine the objective criteria for assessing the success of the probation period for convicts. The issues are how criminal law constructs conditional death penalty regulations and what the objective criteria are for assessing the success of the probation period. This study uses a normative juridical method with a legislative and conceptual approach. The results of the study show that the construction of the probationary period for the death penalty in the National Criminal Code and Law Number 1 of 2026 concerning Criminal Adjustments reflects a shift in the paradigm of punishment towards a more humane approach that prioritizes restorative, rehabilitative, and corrective justice over mere retribution. Furthermore, Article 100 of the National Criminal Code regulates conditional death penalty, but it is not accompanied by implementing guidelines that regulate assessment indicators such as commendable attitude, remorse, and behavioral change, thus giving rise to potential subjectivity and legal uncertainty. Therefore, the government should promptly establish implementing regulations that provide clear evaluation parameters and transparent, accountable supervision mechanisms, including explicitly determining the institution authorized to conduct supervision and evaluation during the probationary period.
