Abstract
The rapid development ofInformation and Communication Technology (ICT) has facilitated the shift of socio-economic activities to the digital realm, including arisan online (Social Gathering with a Financial Purpose). While offering convenience, this model also creates loopholes for fraudulent acts, leading to complex legal polemics and social realities. This research aims to examine and analyze the legal regulations and inherent risks in the practice of online arisan to understand the criminal liability of the perpetrators. This study employs а normative-empirical legal research method with a socio-legal approach. Data was collected through the study of legislation such as the Criminal Code (KUHP) and the ITE Law, interviews, and relevant literature studies. The findings are expected to provide a deep understanding of the criminal liability of perpetrators and to identify the legal risks faced by creditors (owners) and debtors (members). Practically, this research aims to contribute to the government and law enforcement agencies in formulating more effective policies, while also increasing public awareness of the legal risks in electronic transactions.
