Abstract
The designation of suspects is one of the coercive measures in criminal procedure law, which is based on Constitutional Court Decision Number 21/PUU-XII/2014, which is also contained in Law Number 20 of 2025 concerning the New Criminal Procedure Code (KUHAP). However, in practice, the designation of suspects is often carried out arbitrarily, resulting in violations of human rights (HAM). Therefore, Constitutional Court Decision Number 21/PUU-XII/2014 (MK Decision Number 21/PUU-XII/2014) introduced the concept of examining a suspect candidate, which in practice has become part of the requirements for determining a suspect. This examination of prospective suspects is very important to provide transparency in the investigation and as a space for a person to provide clarification and defense before being named as a suspect. However, in practice, there are often multiple interpretations of the concept of examining prospective suspects, which is due to the fact that the provisions in Constitutional Court Decision Number 21/PUUXII/2014 are still unclear and vague. This study aims to identify the differences in the determination of suspects before and after the issuance of Constitutional Court Decision Number 21/PUU-XII/2014 and after the enactment of the new Criminal Procedure Code, as well as to examine the ideal determination of suspects in the future. The author conducted this research using a normative juridical research method, namely by examining several legal literature in the form of existing laws and regulations in Indonesia. The result of this study is the need for further regulation regarding the concept of detailed examination of suspects in criminal procedure law in Indonesia, namely the new Criminal Procedure Code, for the sake of transparency and protection of human rights of a person who will be named as a suspect.
