Abstract
This study analyzes legal uncertainty in the regulation of justice collaborators in Indonesia, which arises from the unclear definition of the principal offender and the absence of quantitative standards in granting sentencing rewards, ultimately creating room for subjectivity among law enforcement authorities and triggering disparities in judicial decisions. This study employs a normative juridical method with a statutory approach and a comparative law approach, examining the legal systems of the United Kingdom and the Netherlands as jurisdictions that have established more developed frameworks for justice collaborators in the context of organized crime. The findings indicate that the UK legal system clearly distinguishes between principal offenders and accessories and emphasizes the value of assistance provided in uncovering criminal offenses, without treating principal offender status as an absolute barrier to obtaining sentence mitigation. Meanwhile, the Dutch legal system applies a quantitatively measurable sentencing reduction mechanism with specified maximum limits, thereby ensuring legal certainty and predictability in sentencing. A comparison of these two systems demonstrates that clear offender classifications and measurable sentencing incentives play a crucial role in maintaining sentencing proportionality. Based on these findings, this study recommends adopting the UK’s approach to defining principal offenders and the Netherlands’ tiered sentencing reduction mechanism into the national legal framework to reduce judicial subjectivity, strengthen objective legal certainty, and enhance the effectiveness of dismantling organized crime in Indonesia.
