Abstract

The implementation of a contactless, non-stop toll collection system based on Multi Lane Free Flow (MLFF) in Indonesia represents an effort to modernize transportation infrastructure to improve traffic efficiency and public services. However, the implementation of MLFF raises legal issues, particularly concerning overlapping authorities among law enforcement agencies in monitoring and enforcing toll payment compliance. This study aims to analyze the legal framework for MLFF implementation in Indonesia and examine the forms of overlapping authority between institutions within the MLFF law enforcement system, by making comparisons with law enforcement in Austria and Hungary. The research method employed is a normative-empirical juridical approach, using statutory (statute approach), conceptual (conceptual approach), and comparative (comparative approach) methods. Data were obtained through a literature study of legislation, legal documents, and scholarly works, and were supplemented with interviews as supporting data. The results indicate that MLFF regulation in Indonesia remains sectoral and is not yet integrated, leading to unclear authority among the Indonesian National Police, the Toll Road Regulatory Agency, financial institutions, and technology providers. This situation affects legal certainty and the effectiveness of law enforcement concerning MLFF-based toll payment violations. In comparison, Austria and Hungary have implemented MLFF systems with an integrated toll authority model that possesses sole authority in management, supervision, and law enforcement, thereby minimizing conflicts of authority and enhancing road user compliance. This study concludes that regulatory harmonization and institutional strengthening through the establishment of a specific, integrated work unit are necessary to ensure legal certainty, effective law enforcement, and the optimal implementation of MLFF in Indonesia.
