Abstract
This research is motivated by the emergence of misconceptions regarding the practice of partial autopsy in the evidentiary process of premeditated murder cases. In several instances, including cases that have gained public attention, the collection of specific organ samples is often assumed to constitute a form of partial autopsy, even though such terminology and procedures are not recognized within Indonesia’s legal framework. This misconception raises questions concerning the legality of such actions and their implications for evidentiary strength in court proceedings. This study employs a normative juridical method with statutory, conceptual, grammatical, and systematic approaches. The analysis is conducted through normative interpretation to assess the conformity of organ sample collection with forensic standards and positive legal provisions. The findings show that forensic autopsy procedures in Indonesia must encompass both external and internal examinations comprehensively. There is no legal basis recognizing the existence of partial autopsy, making the collection of organ samples without a full examination inconsistent with forensic standards and statutory regulations. Such actions also fail to provide scientific certainty regarding the cause of death. These findings affirm that examinations conducted outside procedural requirements lack adequate evidentiary value and may lead to errors in judicial processes. Therefore, the understanding of law enforcement personnel regarding autopsy regulations must be strengthened to ensure that evidentiary processes in premeditated murder cases fulfill the principles of legal certainty, justice, and scientific accuracy.
