Abstract

Law enforcement regarding unauthorized photography has not been firmly followed up by authorities, and vague regulations have led to broad interpretations of norms. The purpose of this study is to identify and analyze the problems in the regulation and enforcement of laws regarding unauthorized photography. The problem is how the law regulates the practice of unauthorized photography and how the law is enforced against unauthorized photography in street photography. This study utilizes a normative juridical method with a statutory and conceptual approach. The results show that the regulation on unauthorized photography does not explicitly prohibit it, but there are laws that can be used to resolve legal issues. Secondly, regarding law enforcement, many officers still do not understand the regulations used, including the biometric data element as a strong basis for the prohibition on unauthorized photography. The conclusion of this study is that regulations prohibiting unauthorized photography exist, but their enforcement has not been carried out properly.
