Abstract
The prevalence of sexual violence cases resolved outside the judicial process is a serious problem because it relates to the fulfillment of the rights of victims of sexual violence. This study aims to determine the mechanisms for resolving criminal cases of sexual violence outside the judicial process and to analyze the fulfillment of the rights of victims of criminal acts of sexual violence resolved outside the judicial process. The problems in this study are how the mechanism for resolving sexual violence cases outside the judicial process works and how the rights of victims are fulfilled in the resolution of sexual violence cases outside the judicial process. This study is a normative legal study with a legislative and conceptual approach. The results of the study show that the settlement of sexual violence cases outside the judicial process cannot guarantee the fulfillment of victims' rights as stipulated in the TPKS Law and the Witness and Victim Protection Law. Although the national legal framework and several regulations have begun to accommodate the principles of restorative justice in certain criminal offenses, this study finds that out-of-court settlements in cases of sexual violence carry the risk of neglecting victims' rights to treatment, protection, and recovery. Non-judicial settlements often deprive victims of access to restitution, rehabilitation, professional support, and long-term legal protection. Therefore, restorative justice can only be used as a complementary approach that remains under the control of the judicial system, with mechanisms that favor victims.
