Abstract
This study aims to analyze the elements of pressure or duress in the formation of agreements and their legal implications under Indonesian civil law. The research focuses on the application of duress as regulated in Articles 1320 and 1321 of the Indonesian Civil Code, the principle of freedom of contract, and the doctrine of misbruik van omstandigheden, which provides a broader understanding of non-physical pressure and imbalanced bargaining positions. Using a normative juridical approach supported by a case study of Supreme Court Decision No. 2935 K/Pdt/2013, this study demonstrates that psychological pressure, investigative circumstances, threats of detention, and the exploitation of a weaker party constitute strong indicators of defective consent in contract formation. The findings also show that agreements concluded under duress may not only be annulled but may additionally result in other legal consequences, such as the loss of evidentiary force and the potential imposition of civil liability on the basis of tort. The Supreme Court’s ruling underscores the role of law as a protective mechanism for vulnerable parties and reaffirms that the principle of freedom of contract is valid only when consent is given freely and voluntarily. Accordingly, this research highlights the need for stronger regulation and more consistent judicial application of the doctrine of defective consent to ensure substantive justice within contractual relations.
