Abstract

The rising divorce rate in Indonesia presents new challenges in fulfilling children's rights, particularly regarding the need to maintain relationships with both parents. In many cases, parents holding custody restrict or even block children's access to their non-custodial parents. This situation is exacerbated by the lack of clear regulations regarding visitation rights in the Marriage Law, the Child Protection Law, or the Compilation of Islamic Law. These three instruments only regulate general parental obligations without providing a definition of visitation, standards of implementation, or enforcement mechanisms to ensure compliance with the decisions. As a result, court decisions regarding visitation rights are often ineffective and merely declarative. Cases such as Decision No. 277/Pdt.G/2012/PA Balikpapan concretely demonstrate how obstruction of visitation can occur without sanction, thus neglecting children's rights to maintain emotional relationships with their non-custodial parents. Through a normative juridical approach and decision analysis, this study reveals that the weaknesses in visitation regulations are structural and have a direct impact on violating the principle of the Best Interests of the Child. The research results indicate that the regulation of visitation rights in Indonesia does not provide adequate legal certainty, both in terms of definition, form, time, place, and mechanisms for implementation and oversight. Therefore, this study recommends a model for regulating visitation rights based on the principle of the child's best interests, including strengthening regulations at the level of laws, implementing regulations, and technical guidelines for the judiciary. This model is expected to guarantee the protection of children's rights, prevent conflict between parents, and create a fair, consistent, and effective system for implementing visitation rights.
