Abstract
Mixed marriages between Indonesian citizens and foreign nationals give rise to complex legal consequences, particularly in relation to the regulation and protection of property rights. One of the central legal issues concerns the potential loss of land ownership rights of Indonesian citizens due to the application of the joint marital property regime, as restricted under Article 21 paragraph (1) of the Basic Agrarian Law. This research aims to analyze the role of prenuptial and postnuptial agreements as legal instruments for protecting the property rights of Indonesian citizens in mixed marriages, as well as to examine the implications of Constitutional Court Decision Number 69/PUU-XIII/2015 on the Indonesian marriage law system. This study employs a normative juridical method using statutory, conceptual, and case approaches, with particular emphasis on the analysis of relevant court decisions. The findings indicate that Constitutional Court Decision Number 69/PUU-XIII/2015 has transformed the national marriage law paradigm by allowing marital agreements to be made after the marriage has taken place. This development strengthens the protection of the economic rights of Indonesian citizens and reflects a shift in Indonesian family law toward a more progressive and substantively just legal framework. Nevertheless, the effectiveness of marital agreements as instruments of legal protection remains constrained by limited public legal awareness and the lack of regulatory harmonization and administrative consistency among legal institutions. Therefore, comprehensive regulatory reform, institutional synchronization, and enhanced legal education are required to ensure that marital agreements function effectively in providing legal certainty and justice for Indonesian citizens involved in mixed marriages.
