Abstract

This study analyzes the application of the principle of balance in prenuptial agreements as a form of legal protection for prospective spouses, based on the Denpasar District Court Decision Number 1308/Pdt.G/2019/PN Dps. The research is motivated by the gap between the normative regulation of the principle of balance in contract law and the practice of prenuptial agreements, which often places one party in a vulnerable position, resulting in an imbalance of rights and obligations and affecting the validity and binding force of such agreements. This study employs a normative juridical method using statutory, conceptual, and case approaches through an analysis of court decisions. The findings indicate that the principle of balance was not optimally applied due to defects of consent arising from differences in language comprehension, contradictory and biased contractual clauses, and the implementation of the agreement that concentrated economic benefits on one party while imposing risks on the other, thereby undermining the validity of the prenuptial agreement and justifying its annulment. The novelty of this study lies in formulating the principle of balance as a three-dimensional evaluative tool covering the formation process, the substance of contractual clauses, and the implementation of prenuptial agreements, examined comprehensively through judicial decisions. This study affirms that the principle of balance constitutes a substantive limit to freedom of contract and a fundamental basis for ensuring fair legal protection for both prospective spouses.
