Abstract

The exclusive rights granted to registered trademarks serve as a fundamental legal mechanism to uphold certainty in business relations and deter unfair competition. This study investigates how the “LUMINOS” trademark’s exclusive rights are safeguarded in its dispute against “LUMINOSLED,” drawing on Decision Number 105/Pdt.Sus Merek/2024/PN.Niaga.Jkt.Pst., while also evaluating the role and accountability of the Directorate General of Intellectual Property (DJKI) within the context of the trademark cancellation proceedings. Employing a normative juridical methodology, the research combines statutory analysis with casebased examination, relying on secondary data interpreted through qualitative analysis. The findings reveal that legal protection for “LUMINOS” was effectively enforced via a cancellation action before the Commercial Court, where the presiding judges established substantial similarity between the marks assessed across visual, phonetic, and conceptual dimensions and confirmed the presence of bad faith in the registration of “LUMINOSLED.” In this case, DJKI’s responsibilities span three key areas: preventive, through rigorous substantive examination during registration; administrative, by maintaining the integrity and accuracy of the Official Trademark Register; and enforcement-oriented, by executing court orders that cancel invalid registrations. This ruling underscores that Indonesia’s trademark regime permits judicial oversight to rectify administrative errors or oversights, thereby reinforcing legal certainty and ensuring substantive fairness in the protection of trademark rights.
