Abstract
The practice of forced menstrual examinations occurring in educational settings under the pretext of enforcing discipline for religious observance is a troubling phenomenon. The purpose of this research is to demonstrate that forced menstrual examinations constitute an act that violates personal privacy and the bodily integrity of female students, and can be categorized as a form of sexual violence as stipulated in Law Number 12 of 2022 concerning Sexual Violence Crimes. The issue examined is how criminal law constructs the offense of forced menstrual examinations and the criminal liability of perpetrators of such coercion. This study employs a normative juridical method with statutory and conceptual approaches. The findings show that forced menstrual examinations can be constructed as a criminal act of sexual violence regulated under Article 4 paragraph (1) letter b in conjunction with Article 6 letters a and c of the Sexual Violence Crimes Law, as well as Article 4 paragraph (2) letter d of the same Law in conjunction with Article 418 paragraph (2) letter b of the Criminal Code. Accordingly, criminal liability may be fully imposed on individuals, namely teachers, as they meet the elements of capacity for responsibility, intentionality, and the absence of exculpatory grounds. Finally, it is important for the Government to conduct socialization regarding the practice of forced menstrual examinations, particularly within educational environments. In addition, law enforcement officials are expected to act firmly, consistently, and proactively in educating everyone to raise awareness of criminal acts related to sexual violence.
