Abstract
Human smuggling is a form of transnational crime that threatens state security, disrupts the integrity of immigration systems, and places victims at significant risk. This study examines the judicial reasoning in two human-smuggling cases: Decision No. 48/Pid.Sus/2023/PN Saumlaki and Decision No. 465/Pid.B/2020/PN Batam. Using a normative juridical approach and content analysis, the research evaluates the application of Article 120(1) of the Immigration Law and the principles of criminal liability under the New Criminal Code (KUHP). The findings show that the judges relied heavily on witness testimonies, financial transactions linked to the defendants, and patterns of conduct indicating involvement in smuggling networks and financial motives. The Saumlaki case portrays the defendant as a strategic facilitator, while the Batam case identifies the defendant as an operational actor directly transporting undocumented migrant workers. However, the study notes that explanations regarding mens rea and the basis for determining imprisonment terms and fines remain insufficient. Although financial transfers were relevant, their direct connection to smuggling activities requires clearer justification. Overall, the decisions align with modern sentencing objectives emphasizing retribution, prevention, and rehabilitation. The study recommends more structured judicial reasoning, clearer articulation of intent and economic motives, and improved investigative capabilities to strengthen the consistency, fairness, and effectiveness of human-smuggling law enforcement.
